Planning Permission Guarantee
The headline terms of the Planning Permission Guarantee are described below. The full contractual terms are set out in Section 15 of our Terms of Service — those are the binding terms; this page summarises them in plain English. The offer
The Planning Permission Guarantee is included automatically on all pre-paid packages — that is, any package paid in full up-front. If your planning application — submitted using Arkiplan-prepared drawings, with us acting as your planning agent — is refused by the local authority, you may choose between two remedies:
- Option A: 50% fees refund. We refund 50% of the Arkiplan fees you've paid us (excluding the £499 initial deposit which covers your 3D scan and design consultation). Choosing this option ends the engagement — we keep ownership of the drawings produced to date and the contract is closed.
- Option B: Continue at no extra cost. We keep working with you, free of charge — amending the design and resubmitting the application as many times as reasonably necessary, until either a similar scheme is approved or you decide to stop pursuing it. Most clients prefer this option, because the goal is approval rather than a refund.
What's covered
The guarantee applies to:
- Lawful Development Certificate Applications
- Householder Planning Applications
- Full Plans Building Control Applications
...where Arkiplan acted as your planning agent and submitted the application on your behalf, using drawings we produced.
What's not covered
The guarantee does not apply to:
- Prior Notification Applications (also called Prior Approval applications) — these are subject to neighbour consultation and the outcome is outside our control
- Schemes previously refused or withdrawn on the same plot before you engaged Arkiplan
- Applications for new dwellings or residential units requiring pre-application advice (the outcome of pre-application advice is not covered)
- Applications materially changed by the applicant after sign-off, or withdrawn before a decision
- Conditional approval — that counts as approval, not refusal
Where Arkiplan reasonably believes a project falls outside the guarantee, we'll tell you in writing before you submit. You can still proceed; you just won't have the guarantee on that application.
Claiming
If your application is refused and you want to claim:
- Email gemma@arkiplan.co.uk within 60 days of the decision notice, attaching the council's refusal notice
- Tell us whether you'd prefer Option A (50% fees refund) or Option B (free resubmission)
- For Option A, refunds go to the original payment card within 14 working days. For Option B, your designer is back in touch within 5 working days to plan the resubmission
